These terms are an agreement between you and Hyperdrive Technologies Pte. Ltd. (“Sleep Gem”, “we”, “us”), a company registered in Singapore, covering the Sleep Gem mobile app and this website (together, the “Service”). By using the Service you agree to them. If you do not agree, please do not use the Service.
1. What Sleep Gem is, and is not
Sleep Gem helps parents and caregivers log a baby’s sleep and care, and offers guidance on sleep timing based on those logs and on typical patterns for a child’s age. Sleep Gem provides general information for reference only. It is not medical advice, diagnosis or treatment, and it is not a medical device. Every child is different. For any concern about your child’s health, feeding, breathing, development or sleep, consult your paediatrician or another qualified professional, and in an emergency contact your local emergency services.
You remain fully responsible for decisions about your child’s care and for how you use the Service. Never leave a child unattended on the basis of anything the Service tells you.
2. Your account
You may use the Service as a guest or with an account. You must be at least 18 years old and the parent or legal guardian of any child whose information you enter, or acting with that person’s permission. Keep your login details confidential; you are responsible for activity under your account. If you share your account with a partner or caregiver, you are responsible for their use of it. Tell us promptly if you believe your account has been compromised.
3. Your content
You own the information you enter. You grant us a licence to store, process and display it as needed to provide the Service to you and the people you share it with. You also agree that we may use your logs, in aggregate and in a form that cannot identify you or your child, to research and improve the accuracy of our sleep guidance for all users. The live monitor and any Wi‑Fi camera you connect stream between your own devices, as the privacy policy describes. Stored detection snapshots are uploaded to Sleep Gem only if you opt in to cloud presence detection, or if you choose to share a snapshot when reporting a wrong detection. Cot-area snapshots you consent to share are used to train Sleep Gem’s own detection model as described in the privacy policy, which also explains how we handle everything else.
4. Acceptable use
Do not use the Service to break the law, to enter information about a child you are not responsible for, to attempt to access other users’ data, to reverse engineer or copy the Service or its models, to interfere with its operation, or to send spam or abusive messages through it (including invitation features).
5. Fees
The Service is currently free. If we introduce paid features, we will describe them and their price clearly before you are asked to pay, and any purchase will be governed by the terms of the app store you buy through.
6. Availability and changes
We work to keep the Service available and accurate, but it is provided “as is” and we do not promise it will be uninterrupted, error-free or suitable for any particular purpose. We may change, suspend or discontinue features at any time. Where a change materially reduces the Service, we will make reasonable efforts to give at least 30 days’ notice.
7. Intellectual property
The Service, including its software, models, design and content (other than your content), belongs to us or our licensors and is protected by intellectual property laws. These terms give you a personal, non-transferable licence to use the app on devices you own or control. Open-source components are listed in the app under About → Open-source licences.
8. Disclaimer and limitation of liability
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and accuracy of information. We will not be liable for any indirect, incidental, special or consequential loss, or for any loss arising from reliance on guidance provided by the Service. Our total liability to you for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim and SGD 100. Nothing in these terms excludes liability that cannot be excluded by law.
9. Ending the agreement
You can stop using the Service at any time and delete your account from within the app; the privacy policy describes what deletion removes and how to request erasure of any remaining records. We may suspend or close accounts that breach these terms or that we reasonably believe pose a risk to other users or the Service. Sections 3, 7, 8 and 10 survive termination.
10. General
These terms are governed by the laws of Singapore, and the courts of Singapore have exclusive jurisdiction over any dispute, without prejudice to any mandatory consumer protections you enjoy where you live. If any part of these terms is found unenforceable, the rest remains in effect. We may update these terms; if a change is material we will make reasonable efforts to give at least 30 days’ notice in the app or by email before it takes effect. Continuing to use the Service after that date means you accept the updated terms.
